WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND TERMS OF USE AGREEMENT

1. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

I voluntarily agree to use the facilities at American Cold Plunge and Sauna and understand that the services provided, including the use of the cold plunge tub (as low as 39°F) and infrared sauna (up to 140°F), involve inherent risks, including but not limited to:

  • Risk of injury, including but not limited to: dehydration, burns, heat exhaustion, hypothermia, dizziness, cardiac events, fainting, or other medical complications.
  • Risk of using an unattended facility: No employees are on staff to assist. The common area is monitored by a third-party security company in case of emergency.
  • Personal responsibility: I acknowledge that I am in good health, have no known medical conditions that may prevent me from using these services safely, and assume full responsibility for my well-being.

By agreeing to this waiver, I voluntarily release, waive, discharge, and hold harmless American Cold Plunge and Sauna, its owners, operators, affiliates, and employees from any and all liability, claims, demands, actions, or causes of action related to any loss, damage, or injury that may occur while using the facilities.

2. RULES AND REGULATIONS

Facility Use & Safety Guidelines

  • The facility is for single-person use only per booking. Any additional person will be charged the same price as the original booking.
  • Proper bikini/swimwear must be worn at all times. Nudity is strictly prohibited outside of designated dressing areas.
  • Participants must scan in and out of the facility using the automatic Bluetooth door reader system. This system records the exact time of entry and exit for tracking usage.
  • An emergency door release is available and should only be used in case of emergency. Misuse may result in penalties.
  • The facility is monitored by a third-party security service for safety purposes.

Time Management & Late Fees

  • Participants are responsible for monitoring their own time.
  • Staying beyond the booked session will result in a charge of $3 per additional minute.
  • One courtesy warning will be given per violation before penalties apply.
  • Repeated violations of overstay policies may result in membership cancellation.

Booking Time

  • Booking times for Cold Plunge will be **20 minutes** with a **5-minute grace period**.
  • Booking times for **Sauna and Cold Plunge or Sauna only** will be **45 minutes** with a **10-minute grace period**.
  • Additional charges will start **after the grace period**.

Cleaning & Facility Maintenance Fees

  • Used linens must be placed in the designated receptacle after use. Failure to do so will result in a $15 cleaning fee.
  • Leaving excessive puddles of water that require additional cleaning and disrupt the next appointment will result in a $50 fee.
  • One courtesy warning will be given per violation before penalties apply.

Personal Items

  • Please refrain from bringing any personal items into the Cold Plunge and Sauna areas.
  • American Cold Plunge and Sauna accepts no responsibility for lost or stolen items.

Cancellation Policy

• If you need to reschedule or cancel a booked appointment, please do so online at least 1 hour prior to your appointment.

3. HEALTH & MEDICAL DISCLAIMER

I confirm that I:

  • Do not have any medical conditions (such as cardiovascular issues, high blood pressure, or other conditions) that may pose a risk while using heat or cold exposure therapy.
  • Am not under the influence of alcohol, drugs, or any substances that may impair my judgment while using the facilities.
  • Understand that American Cold Plunge and Sauna does not provide medical supervision and is not responsible for any medical emergencies that may arise.

4. PHOTO & VIDEO MONITORING

I understand that the common area is monitored for security purposes and consent to video monitoring for safety. These recordings will only be used for security, emergency response, and policy enforcement.

5. AGREEMENT TO TERMS

By using the facilities, I agree that:

  1. I have read and understood this waiver in full.
  2. I voluntarily assume all risks associated with the use of the facility.
  3. I will comply with all facility rules and regulations.
  4. I understand that failure to comply with these terms may result in additional charges or termination of access.
